MINI SESSION TERMS & CONDITIONS

PHOTOGRAPHER’S RESPONSIBILITIES. (“Services”)
Melissa Glynn Photography (“Photographer”) Photographer hereby agrees to perform photographic services for Client at the Event specified above in a professional, workmanlike manner according to the prevailing standards in the industry. Photographer may employ one or more assistants. Photographer shall, in consultation with the Client, individually edit, optimize, color-correct, enhance, and retouch the images taken at the Event.

PAYMENTS
A non-refundable retainer (that shall be applied toward the total fee for the Services) of 50% of the total balance is due upon execution of this Agreement, at which time Photographer commits to being available to Client on that date (subject to non-payment, reasonable emergencies, and major events). The final payment is due on the day of your session. No part of any order, including previews, will be delivered until the balance is paid in full. a. Late Fees. Payments are due on the specified due dates in your contract. If payment is five days past due, a $50 fee will be applied to your account and a daily fee of $25 will be applied for every day after that the full payment is not made.

COPYRIGHT
All photographs taken by Photographer at the Event, in whatever form, are copyright protected. Any copying, scanning, reprinting, duplicating, or altering of the photographs taken by Photographer, without Photographer’s express written permission is a violation of federal copyright law. The photographs taken by Photographer are Photographer’s sole property unless purchased by Client and permission is expressly granted in the contract and package contents. If Client purchases Digital Photographs (delivered via digital download), Client is granted limited rights for personal use only.

  • In the event Client needs to use images for business/marketing purposes, Client is required to pay an additional licensing fee and give proper photo credit to Photographer in the format requested. (i.e. "Photo by Melissa Glynn").

  • If Client is interested in purchasing an unlimited license for business purposes, please inquire with Photographer for options available.

  • When sharing images online, Client agrees not to alter the image(s) in any way. No filters or cropping can be applied as those changes alter the presentation and representation of the art created by Photographer.


TERM
The term of this Agreement shall commence upon the execution of this Agreement, and shall terminate upon Photographer’s delivery of the final products listed in the package contents unless terminated earlier as provided herein.

APPOINTMENT CHANGES
If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of the studio/photographer, Photographer may elect to use an alternate location or to reschedule the appointment. Due to the way these sessions are scheduled and the amount of people included, rescheduling is a difficult process within the month before your appointment. Please note there are fees applied to any appointment rescheduled less than 30 days out from your contracted appointment.

RESCHEDULING FEES
Appointments may be rescheduled by Client without penalty up to 31 days before your scheduled session. If you need to reschedule your appointment for any reason 15-30 days before your appointment, there is a $50 rescheduling fee. All appointments rescheduled within 7-14 days before your appointment will be charged a $100 rescheduling fee. Appointments rescheduled six days or less from your appointment date will be charged $175 to reserve a new appointment. No exceptions.

You may move your appointment to a future “Mini Session” date within twelve months of the original appointment date. If the appointment is not rescheduled by then, the contract is terminated, deposit is lost and a new appointment can only be booked if a new contract is signed and deposit is paid. A new appointment may only be scheduled on selected future "Mini Session" dates.

(Rescheduling fees are required because your appointment has been reserved for you up until the point you need to reschedule. That may have prevented me booking another client in that spot - which means I miss out on that potential profit.)

*****In the event you are a no show or you arrive six minutes or more after your appointment’s scheduled start time, your appointment automatically will be cancelled for that day. You will then have to pay a $175 rescheduling fee to get a new appointment on the calendar. No exceptions.

CANCELLATION
Upon acceptance of these terms and payment of the retainer, Photographer shall commit to attending the appointment at the specified date and time and shall make no other reservations for that date and time. If Client cancels the appointment entirely, then Photographer will terminate your contract and keep all payments made up to that date.

PROOFS
A presentation of the images selected by Photographer in its sole discretion (“Proofs”) shall be made available to Client via an online gallery 14-21 days following the session. Your online gallery will be live for 30-days but can be extended for an additional 30 days for $50.

Due to the amount of storage required for today's digital imaging technology and the high quantity of images I create every year, I can only guarantee the archival of your images for up to six months. After that time, your images will be deleted from my archives. You are welcome to purchase your images before that time or pay for additional archival time at the rate of $150/year.

EDITS
Proofs may include artistic enhancements or touch-ups added to the images in Photographer’s sole discretion. Mini Session edits include adjustments to lighting, color and cropping/straightening. All additional edits are allowed by request only. Editing fees start at the rate of $25/image. All edit requests must be made via email within seven business days of your gallery launch date. After the seven days, all images are deemed final and will be delivered to you via email. Edit requests can include things like blemish removal, background/distraction removal, skin smoothing, hair smoothing, etc. All edit requests submitted after the images are delivered will require an un-archival fee of $100.

DELIVERY DATE
An online gallery of your proofs will be available 14-21 days after your session date. All digital images purchased will be delivered within seven days of your online gallery being delivered. Once the download link has been sent, you cannot request changes to your image selections delivered. If you lose your images or fail to download your images before the link expires, there will be a $50 fee to resend your collection.

PRICE PROTECTION
Photographer warrants all prices quoted are valid for a period of 15 days following the contract signing. Orders placed after such period are subject to Photographer’s published pricing at the time of the order's placement.

MODEL RELEASE
Client agrees that Photographer may use images of Client from any portion of the Work for display, publication, or other promotional uses without payment of additional compensation to Client or Client’s agents.

JURISDICTION
The state and federal courts serving Travis County, Texas shall have exclusive jurisdiction over disputes arising from this Agreement, and both parties hereto consent to the jurisdiction of such courts.

ATTORNEY’S FEES
The prevailing party in any litigation or dispute involving this Agreement, or the Services performed thereunder, shall be entitled to recover reasonable attorney’s fees, costs, and expenses arising from such litigation or dispute from the non-prevailing party.

ASSIGNMENT. This Agreement may not be assigned.

LIMITATION OF LIABILITY. PHOTOGRAPHER’S ENTIRE LIABILITY FOR ANY CLAIM, LOSS, DAMAGE, OR INJURY ARISING UNDER OR RELATING TO THIS AGREEMENT IS LIMITED TO THE FEES PAID BY CLIENT FOR THE SERVICES. IN NO EVENT SHALL PHOTOGRAPHER BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF CLIENT INFORMS PHOTOGRAPHER OF CIRCUMSTANCES THAT WOULD GIVE RISE TO SUCH DAMAGES.
